Rental Terms and Conditions

These Rental Agreement Terms and Conditions (“Terms”) apply to all vehicle rentals made with Gumbsie Car Rental, whether booked online through gumbsiecarrental.com, gumbsiecarrental.ai, by telephone, email, WhatsApp, through a travel partner, hotel, travel agent, online travel agency, or directly at one of our rental locations.
By making a reservation, paying a deposit, collecting a vehicle, or using any vehicle supplied by Gumbsie Car Rental, the renter confirms that they have read, understood and agree to be legally bound by these Terms.
These Terms form part of every Rental Agreement entered into with Gumbsie Car Rental.
1. Eligibility Requirements
To rent a vehicle, the renter must:
• Be at least 21 years of age. Certain vehicle categories may have higher minimum age requirements.
• Hold a valid driving licence issued by their country of residence.
• Obtain and carry a valid Anguilla Temporary Driving Permit where required by law.
• Present valid government-issued photographic identification.
• Provide a valid credit or debit card acceptable to Gumbsie Car Rental.
Meeting the minimum requirements does not guarantee a rental.
Gumbsie Car Rental reserves the absolute right to refuse any rental or authorised driver at its sole discretion without providing a reason.
2. Reservations and Confirmation
All reservations are subject to vehicle availability.
A reservation is confirmed only when payment or any required deposit has been successfully received or authorised by Gumbsie Car Rental.
The renter is responsible for ensuring that all information supplied is complete and accurate, including travel details, contact information and driving licence details.
Gumbsie Car Rental reserves the right to cancel any reservation where:
• payment cannot be verified
• fraudulent activity is suspected
• incorrect or misleading information has been supplied
• operational circumstances prevent fulfilment of the reservation
Any reservation obtained through fraudulent means shall be cancelled without refund.
3. Rental Period
The rental period begins on the date and time shown on the Rental Agreement and ends when the vehicle has been returned, inspected and accepted by Gumbsie Car Rental.
Vehicles returned after the agreed return time may be subject to additional daily rental charges.
Rental extensions are not guaranteed and must be approved before the scheduled return time.
Returning a vehicle early does not entitle the renter to any refund, credit or reduction in rental charges.
4. Vehicle Use
The renter agrees that the vehicle shall only be used:
• by authorised drivers named on the Rental Agreement
• on public roads within Anguilla
The vehicle must not be used:
• for racing, competitions or speed testing
• for driving instruction
• for carrying passengers or goods for hire or reward
• for any illegal purpose
• while under the influence of alcohol or drugs
• in a reckless, negligent or dangerous manner
Vehicles must not be removed from the island of Anguilla without the prior written consent of Gumbsie Car Rental.
Any breach of this section constitutes a material breach of the Rental Agreement and may result in immediate termination without refund.
5. Fuel Policy
Vehicles are supplied with the fuel level recorded on the Rental Agreement.
The vehicle must be returned with the same fuel level.
Where the vehicle is returned with less fuel, Gumbsie Car Rental will charge the cost of the missing fuel together with a refuelling service fee.
6. Charges, Payments and Security Deposits
The renter agrees to pay all charges relating to the rental including but not limited to:
• rental charges
• optional extras
• insurance or damage waiver products
• temporary driving permits
• additional driver fees
• delivery and collection charges
• fuel charges
• cleaning charges
• damage charges
• traffic fines
• parking violations
• recovery costs
• administration fees
A security deposit may be required before collection.
The security deposit does not limit the renter’s liability.
Where costs exceed the security deposit, the renter remains liable for the full balance.
Gumbsie Car Rental reserves the right to charge the payment method provided for any outstanding amounts identified during or after the rental period.
7. Cancellation Policy
All cancellation requests must be submitted in writing by email.
Cancellation more than 45 days before the scheduled pickup date
The renter will receive a full refund of all monies paid.
Cancellation between 30 and 44 days before the scheduled pickup date
No cash refund will be issued.
The full amount paid will be converted into a rental credit valid for twelve (12) months from the original pickup date.
Rental credits are non-transferable, have no cash value and may only be redeemed by the original renter unless otherwise approved by Gumbsie Car Rental.
Cancellation less than 30 days before the scheduled pickup date
No refund or rental credit will be issued.
No Shows
Failure to collect the vehicle on the agreed pickup date and time without prior written notice shall constitute a No Show.
In the event of a No Show:
• all monies paid shall be forfeited
• the reservation will be cancelled
• the vehicle may be released for re-rental immediately
Early Returns
No refunds, credits or partial reimbursements shall be given for vehicles returned before the agreed return date.
Any amendment to a reservation is subject to vehicle availability and the rates applicable at the time of amendment.
This cancellation policy applies regardless of the booking source unless expressly agreed otherwise in writing.
8. Vehicle Condition
The vehicle is supplied clean and in good working order.
The renter must inspect the vehicle before leaving the rental location and immediately report any existing damage.
Failure to report existing damage before departure shall be deemed acceptance that the vehicle was supplied free from additional damage.
Photographs and inspection reports prepared by Gumbsie Car Rental before and after the rental shall be considered evidence of the vehicle’s condition.
9. Damage and Liability
The renter is responsible for all loss of or damage to the vehicle occurring during the rental period regardless of fault, subject only to any damage waiver or protection product purchased and the applicable terms of that product.
The renter remains liable for any damage caused by:
• negligence
• misuse
• unauthorised drivers
• driving under the influence
• breaches of these Terms
Gumbsie Car Rental may recover all reasonable costs including repairs, replacement parts, towing, recovery, loss of rental income and administrative costs.
10. Insurance
Any optional protection products purchased from Gumbsie Car Rental are contractual damage waiver products and are not insurance policies.
The renter remains responsible for complying with all terms, exclusions and conditions applicable to the selected protection product.
Gumbsie Car Rental accepts no responsibility for personal belongings left inside the vehicle.
11. Breakdowns and Accidents
Any accident, theft, damage or mechanical issue must be reported immediately to Gumbsie Car Rental.
Where required, the renter must also notify the Royal Anguilla Police Force.
The renter must cooperate fully with any investigation.
Repairs must not be authorised without the prior written approval of Gumbsie Car Rental.
Unauthorised repair costs shall be the responsibility of the renter.
12. Cleaning
Vehicles must be returned in a reasonably clean condition.
Where excessive dirt, sand, stains, pet hair, smoking residue, spills or other contamination require specialist cleaning, Gumbsie Car Rental reserves the right to charge a reasonable cleaning fee.
Smoking and vaping are strictly prohibited inside all vehicles.
13. Lost Keys
The renter is responsible for all costs associated with lost, stolen or damaged keys, key remotes or replacement locks where necessary.
14. Termination
Gumbsie Car Rental may terminate the Rental Agreement immediately without notice where:
• these Terms have been breached
• the vehicle has been misused
• false information has been supplied
• the vehicle has not been returned when due
• the vehicle is being operated unlawfully
Termination shall not affect Gumbsie Car Rental’s right to recover all outstanding charges or damages.
No refund shall be payable where the Rental Agreement is terminated due to the renter’s breach.
15. Limitation of Liability
To the fullest extent permitted by applicable law, Gumbsie Car Rental shall not be liable for:
• missed flights
• missed ferries
• missed accommodation
• missed events
• loss of business
• loss of enjoyment
• indirect or consequential losses
• delays arising from weather, traffic, mechanical breakdown or events beyond our reasonable control.
16. Amendments
Gumbsie Car Rental may amend these Terms at any time.
The latest version published on our website shall apply to all future reservations.
17. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of Anguilla.
Any dispute arising from the rental shall be subject to the exclusive jurisdiction of the Courts of Anguilla.
18. Entire Agreement
These Terms, together with the Rental Agreement and any documents expressly incorporated into it, constitute the entire agreement between Gumbsie Car Rental and the renter.
Failure by Gumbsie Car Rental to enforce any provision of these Terms shall not constitute a waiver of its rights.
